Eviction

The court process a landlord uses to regain possession of a unit from a resident who has not left voluntarily.

An eviction usually begins with a required notice, such as a notice to pay rent or quit, followed by a court filing, a hearing and, if the landlord wins, an order enforced by a sheriff or marshal. Self-help measures such as changing locks or shutting off utilities are generally illegal.

Notice periods, allowed reasons and required disclosures vary greatly by state and city, and some areas require just cause. Work with local counsel before starting any eviction.
